3. Use of Services

Eligibility

You must be at least 21 years of age and legally capable of entering into binding contracts under Singapore law to engage our services. By using our services, you represent and warrant that you meet these requirements.

Account Responsibilities

If you create an account or profile with us, you are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

Accurate Information

You agree to provide accurate, current, and complete information when engaging our services. Providing false or misleading information may result in termination of services and could affect your ability to secure rental properties.

4. Prohibited Uses

When using our services, you agree not to:

• Violate any applicable laws or regulations of Singapore
• Infringe upon intellectual property rights of Aldwyn or third parties
• Transmit viruses, malware, or other harmful code
• Attempt unauthorized access to our systems or client data
• Engage in fraudulent activities or misrepresent your identity
• Harass, abuse, or harm other clients or our staff
• Use automated systems to access our services without permission
• Attempt to resell or redistribute our services without authorization
• Interfere with the proper functioning of our services

5. Intellectual Property

Ownership

All content, materials, and intellectual property associated with Aldwyn's services, including but not limited to our website, proprietary research methods, property analysis frameworks, and documentation templates, remain our exclusive property or that of our licensors.

Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use materials provided to you for the purpose of evaluating properties and completing your rental transaction. This license does not permit commercial use or redistribution.

Restrictions

You may not copy, modify, distribute, sell, or reverse engineer any proprietary materials, methodologies, or systems we provide. Violation of these restrictions may result in legal action.

6. Payment Terms

Service Fees

Our service fees are stated in Singapore Dollars (SGD) and are specified in the service proposal or agreement you receive. Fees are due according to the payment schedule outlined in your specific service agreement.

Payment Methods

We accept payment via bank transfer, credit card, or other methods as agreed upon. Payment processing may be subject to third-party terms and conditions.

Late Payment

If payment is not received according to the agreed schedule, we reserve the right to suspend services until payment is received. Late payments may incur additional administrative fees.

Price Changes

Service fees quoted are valid for the engagement period specified. We reserve the right to adjust pricing for future engagements with reasonable notice.

Taxes

All fees are exclusive of applicable taxes, which will be added to invoices as required by Singapore tax regulations. You are responsible for payment of all applicable taxes.

7. Refund Policy

Given the professional advisory nature of our services:

• Service fees paid for consultations and research already provided are non-refundable
• If you choose to discontinue services before completion, fees for work performed will be retained
• Refunds for unused portions of prepaid services may be considered at our discretion

Third-Party Decisions

Property owners, landlords, and management companies make independent decisions regarding lease applications. While we advocate for our clients, we cannot control or guarantee these third-party decisions.

Market Conditions

Real estate markets fluctuate. Information and property availability may change. We provide current information to the best of our knowledge but cannot guarantee that conditions will remain constant.

Professional Judgment

Our consultants exercise professional judgment in providing advice and recommendations. However, final decisions regarding property selection and lease terms rest with you as the client.

9. Disclaimers and Limitations of Liability

"As Is" Provision

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We make no representations regarding uninterrupted service, error-free operation, or specific outcomes.

Property Information

While we strive for accuracy, property information is sourced from third parties. We cannot warrant the complete accuracy of all property details, neighborhood information, or market data provided.

Limitation of Liability

To the maximum extent permitted by Singapore law, Aldwyn's liability for any claims arising from our services shall not exceed the fees paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

Excluded Damages

We are not liable for:

• Lost profits or business opportunities
• Emotional distress or inconvenience
• Third-party actions or decisions
• Force majeure events beyond our reasonable control
• Client decisions based on our advisory services

10. Client Responsibilities

As a client, you are responsible for:

• Providing accurate and complete information when engaging our services
• Conducting your own due diligence on properties before making commitments
• Reading and understanding lease agreements before signing
• Meeting financial obligations to property owners and Aldwyn
• Complying with lease terms once agreements are executed
• Notifying us promptly of any changes to your requirements or circumstances
• Treating our staff and other parties with professional courtesy

11. Termination

Client Termination

You may terminate our services at any time by providing written notice. Fees for services already provided will remain due. Partial refunds may be considered for unused prepaid services at our discretion.

Aldwyn Termination

We reserve the right to terminate services if:

• Payment obligations are not met
• You provide false or misleading information
• You engage in prohibited activities outlined in these Terms
• Continued service would violate professional standards or regulations
• The working relationship has broken down irreparably

Effects of Termination

Upon termination, your right to use our services ceases immediately. Provisions regarding payment, confidentiality, intellectual property, and limitation of liability survive termination.

12. Dispute Resolution

Informal Resolution
